“(1A) The local authority referred to in paragraph (1)(c) is—

(b)in a case where the child is a pupil at a school which is not maintained by a local authority, the local authority for the area of which the school is situated.”.
19.—(1) Regulation 8 of the Placement of Children with Parents etc. Regulations 1991 is amended as follows.
(2) For paragraph (4)(b)(10) substitute—
“(b)the local authority, if it is different from the area authority, specified in paragraph (4A);”.
(3) After paragraph (4) insert—
“(4A) The local authority referred to in paragraph (1)(c) is—
(a)the local authority which —
(i)maintains any school at which the child is, or is proposed to be, a pupil , or
(ii)makes arrangements for the provision of education for the child otherwise than at school pursuant to section 19 of the Education Act 1996, or
