39.  In section 5 (judges and other members of the Upper Tribunal)—

(a) omit subsection (1)(d); and

(b) in subsection (2)—

(i) at the end of paragraph (b) insert “or”; and

(ii) omit paragraph (d) (together with the “or” immediately before it).
