The Secretary of State makes the following Order in exercise of the powers conferred by section 21 of the Clean Air Act 1993(1).
The Secretary of State is satisfied that the fireplaces exempted by this Order can be used for burning fuel other than authorised fuels(2) without producing any smoke or a substantial quantity of smoke.
Fuels declared by the Secretary of State to be authorised fuels for the purposes of Part III of the Clean Air Act 1993 under section 20(6) of that Act are specified in S.I. 2008/514, as amended by S.I. 2008/2342, S.I. 2009/2191 and S.I. 2010/576.
