The Primary Care Trusts (Membership, Procedure and Administration Arrangements) Amendment Regulations 2010

The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 272(7) and (8) of, and paragraph 4(1)(a) of Schedule 3 to the National Health Service Act 2006(1).

Citation and commencement

1.  These Regulations may be cited as the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Amendment Regulations 2010 and shall come into force on 1st December 2010.

Amendment of regulation 5

2.—(1) In regulation 5 (disqualification for appointment: chairman and non-officer members) of the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Regulations 2000(2)—

(a)omit paragraph (1)(e)(i); and

(b)in paragraph (4)(a), omit “another trust, another trust’s Executive Committee or”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Primary Care Trusts (Membership, Procedure and Administration Arrangements) Regulations 2000. They remove the disqualification which prevents a person who is a chairman or member of one Primary Care Trust or the Executive Committee of such a trust from being appointed as the chairman or a non-officer member of another Primary Care Trust.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
