Single justice's power to refer to a magistrates' court2
Where a single justice —
a
is performing the function of a magistrates' court in accordance with rules 2.5(1)(c)(ii) and 2.6(1) and (2); and
b
considers, for whatever reason, that it is inappropriate to perform the function,
the single justice must refer the matter to a magistrates' court which may perform the function.
