The Secretary of State, in exercise of the powers conferred by sections 144, 145 and 320 of the Housing and Regeneration Act 20081, makes the following Order:

Citation and commencement1

This Order may be cited as the Housing and Regeneration Act 2008 (Moratorium) (Prescribed Steps) Order 2010.

This Order comes into force on 1st April 2010.

Prescribed steps2

Any step to enforce security over land held by a registered provider of social housing shall be a prescribed step for the purposes of sections 144 or 145 of the Housing and Regeneration Act 2008.

EXPLANATORY NOTE

(This note is not part of the Order)

Under section 144 of the Housing and Regeneration Act 2008 taking a prescribed step only has effect if the person taking it has given notice to the Regulator of Social Housing. Under section 145 of the Act a moratorium, which prevents a registered provider of social housing making any disposals of land without consent of the Regulator of Social Housing, begins when a prescribed step is taken. This Order prescribes the steps for the purposes of those provisions as any step to enforce a security over land held by a registered provider of social housing.

An impact assessment has not been produced, because no impact on the costs of business, the public sector, third sector organisations, regulators or consumers is foreseen. An Explanatory Memorandum has been prepared and is available alongside the instrument on the OPSI website at www.opsi.gov.uk.
