Schedule 25 (waste and extractive waste) has effect.

Section 33(1)(a) of the 1990 Act (prohibition on unauthorised deposit of waste) M1—

a

does not apply to an operation which—

i

falls within a description in Part 3 of Schedule 25, and

ii

meets the conditions specified in that Part for an operation of that description; and

b

does not apply to extractive waste at any time before the requirement for an environmental permit under regulation 12 applies in respect of the deposit of that waste.
