At the beginning of Chapter 3 of Part 4, before Rule 4.7, insert—

“4.6AInjunction to restrain presentation or advertisement of petition

An application by a company for an injunction restraining a creditor from—

(a)

presenting a petition for the winding up of the company must be made to a court having jurisdiction to wind up the company;

(b)

advertising a petition for the winding up of a company must be made to the court in which the petition is pending.”.
