Coming into force

The Secretary of State for Children, Schools and Families makes the following Order in exercise of the powers conferred by section 123(4)(a) of the Education Act 20021:

This Order may be cited as the School Teachers’ Incentives Payments (England) Order 2010 and comes into force on 1st July 2010.

This Order applies only in relation to school teachers in England.

Incentive payments to school teachers2

A lump sum payment made by a local authority in England or the governing body of a school maintained by such an authority to a school teacher under the Golden Handcuff Programme administered by the Department for Children, Schools and Families is not to be treated as remuneration for the purpose of section 122(1) of the Education Act 2002.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order provides that lump sum payments paid to school teachers in England under the Golden Handcuff Programme administered by the Department for Children, Schools and Families, are not to be treated as remuneration for the purpose of section 122(1) of the Education Act 2002.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
