100. In Schedule 18 (transitional provisions)—
(a)in paragraph 9 (continuation notices), after sub-paragraph (14) insert—
“(14A) Sections 185 to 191 apply to a dispute relating to a provision of a kind mentioned in paragraph (4), other than a dispute relating to provision that OFCOM have power to include in SMP apparatus conditions, as they apply to disputes of a kind mentioned in subsections (1A) and (2) of section 185.”, and
(b)in paragraph 13(8) (enforcement: breaches of licence conditions) at the end insert “, as amended by Directive 2009/140/EC of the European Parliament and of the Council”.

Explanatory Memorandum
Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Instrument and provides information about its policy objective and policy implications. They aim to make the Statutory Instrument accessible to readers who are not legally qualified and accompany any Statutory Instrument or Draft Statutory Instrument laid before Parliament from June 2004 onwards.
