The Secretary of State, in exercise of the power conferred by section 149 of the Local Democracy, Economic Development and Construction Act 20091, makes the following Order:
Citation and interpretation1

This Order may be cited as the Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 2) (England) Order 2011.

In this Order, “the Act” means the Local Democracy, Economic Development and Construction Act 2009.
Extent, application and day of provisions coming into force2
So far as extending to England and Wales, but not in relation to construction contracts which relate to the carrying out of construction operations in Wales, section 138 (to the extent not already in force) and sections 139 to 145 of the Act come into force on 1st October 2011.
