EXPLANATORY NOTE
This Order brings into force section 29(1) to (3), (5) and (6) and section 30 of the Criminal Justice Act 2003 so as to allow the following public prosecutors to institute criminal proceedings by issuing a written charge and requisition:
a person specified by the Secretary of State in an Order under section 29(5)(h) of the Criminal Justice Act 2003 or a person authorised by such a person;
a police force or a person authorised by a police force to institute criminal proceedings in England and Wales, so far as not currently allowed; and
the Secretary of State for Business, Innovation and Skills or a person authorised by the Secretary of State for Business, Innovation and Skills to institute criminal proceedings.
The Criminal Justice Act 2003 (Commencement No. 16) Order 2007 (S.I. 2007/1999), the Criminal Justice Act 2003 (Commencement No. 21) Order 2008 (S.I. 2008/1424), Criminal Justice Act 2003 (Commencement No. 23) Order 2009 (S.I. 2009/2879) and the Criminal Justice Act 2003 (Commencement No. 25) Order 2010 (S.I. 2010/3005) commenced the same provisions in the 2003 Act as they apply to public prosecutors in specified locations.
