Subject to paragraph (2), the amendments made by rule 6 apply to a notice of appeal where written notice of the decision being challenged was sent to the appellant before 9th May 2011.

The amendments made by rule 6 do not apply to any appeal where written notice of the decision being challenged was sent to the appellant—

a

on or before 9 February 2011 in proceedings under section 5(1) of the Pensions Appeal Tribunals Act 1943; or

b

on or before 9 November 2010 in any other case.
