The School Finance (England) (Amendment) Regulations 2011

The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by sections 45A and 138(7) of the School Standards and Framework Act 19981:

Citation and commencement1

These Regulations may be cited as the School Finance (England) (Amendment) Regulations 2011 and come into force on 10th April 2011.

Amendment of the School Finance (England) Regulations 20112

The School Finance (England) Regulations 20112 are amended as follows.

For paragraph 30 of Schedule 2, substitute—

Subject to paragraph (2), expenditure on library services for primary and special schools, provided that the local authority—

a

notify the governing body of each school which does not receive funding for library services in its budget share of the amount attributable to library services for that school; and

b

allow the governing bodies of those schools to determine whether the expenditure on library services in respect of their school is to be spent by—

i

the authority in themselves providing library services to the school; or

ii

the authority procuring library services from another local authority.

Expenditure of the description referred to in paragraph (1) may not be deducted where—

a

funding for library services in respect of a particular school was delegated before April 1999 and remains delegated; or

b

the governing body of any primary or special school have elected to receive funding for library services as part of their school’s budget share.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the School Finance (England) Regulations 2011 by substituting paragraph 30 of Schedule 2.

Regulation 5(1) of the 2011 Regulations provides that certain types of expenditure, including those specified in Schedule 2, may be included in the school budget and regulation 7(1) provides that local authorities must deduct from their schools budget those types of expenditure set out in Schedule 2 as they propose to deduct, in order to determine their individual schools budget for the funding period. Paragraph 30 of Schedule 2 specifies expenditure on library services for primary and special schools.
