The Road Vehicles (Construction and Use) (Amendment) Regulations 2012

Coming into force

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 19881.

Representative organisations have been consulted in accordance with section 195(2) of that Act.

Citation and commencement1

These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) Regulations 2012 and come into force on 25th June 2012.

Revocations2

The revocations set out in the Schedule have effect.

Amendment of Regulations

The Road Vehicles (Construction and Use) Regulations 19862 are amended as follows.

In paragraph 7 of Part I of Schedule 7B (emissions from certain motor vehicles), for subparagraph (b) substitute—

b

“the emissions publication” is the publication entitled “In Service Exhaust Emission Standards for Road Vehicles - Seventeenth Edition” (ISBN 978-0-9549352-7-6) published by the Department for Transport.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986 (“the 1986 Regulations”).

Regulation 3 amends the definition of “the emissions publication” in Schedule 7B to the 1986 Regulations by referring to the most recent (seventeenth) edition of the Department for Transport publication entitled “In Service Exhaust Emission Standards for Road Vehicles” (ISBN 978-0-9549352-7-6). The publication contains in-use emissions limits that petrol-engined cars and light vans are required to meet for the purpose of MoT and roadside emissions tests. The publication updates information on new models of such vehicles which have come onto the market since the previous amending Regulations (S.I. 2010/2060) came into force on 9th September 2010. It also revises a small amount of data on existing models.

The opportunity has been taken to revoke earlier spent instruments or provisions relating to amendments updating references to previous editions of the emissions publication in Schedule 7B.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. The Explanatory Memorandum for these Regulations is available alongside this instrument on the website www.legislation.gov.uk.
