In subsection (3)—
a
in paragraph (a), after “in the case of” insert “the Waterways Board or”;

after paragraph (a), insert—

in the case of the Waterways Board, to the Scottish Ministers,

In subsection (4)—
a
in paragraph (a), after “in the case of” insert “the Waterways Board or”, and omit the “or” at the end of that paragraph;
b
after paragraph (a), insert—
aa
in the case of the Waterways Board, the Scottish Ministers, or
c
after “as the case may be, to” insert “the Scottish Ministers or”.
