Power to amend Parts 1 and 2

16.

(1)

The F1Secretary of State may by order made by statutory instrument make such amendments of Part 1 or 2 of this Schedule as the F1Secretary of State considers appropriate.

(2)

Any order under sub-paragraph (1) may not be made unless a draft of the order has been laid before, and approved by a resolution of, each House of Parliament.

(3)

The F2Secretary of State may make an order under sub-paragraph (1) either—

(a)

where the order gives effect to a recommendation of the Commission, or

(b)

after consultation with the Commission.

(4)

For the purposes of section 1 of the Statutory Instruments Act 1946 M1 (definition of “Statutory Instrument”), the power to make an order which is conferred by sub-paragraph (1) is to be taken to be conferred by an Act of Parliament.
