3. In regulation 2 for the definition of “council concerned” there is substituted—
““council concerned”—
in relation to an integrated transport authority established under section 28(1) of the Local Government Act 1985(1), means a constituent council of that authority pursuant to section 28(4) of that Act;
in relation to an integrated transport authority established under section 78 of the Local Transport Act 2008, means a constituent council of that authority pursuant to section 79(3) of that Act;
in relation to the Greater Manchester Combined Authority, means a constituent council of that authority pursuant to article 2 of the Greater Manchester Combined Authority Order 2011(2); and
in relation to any other levying body, means a council as respects which the levying body would, apart from section 117 of the 1988 Act(3), have had a relevant precepting power.”

Section 117 of the Local Government Finance Act 1988 was amended by S.I. 1993/616; by the Police Reform and Social Responsibility Act 2011, Schedule 16, paragraph 191; by the Courts Act 2003 (c. 39), Schedule 8, paragraph 305(b); and by the Fire and Rescue Services Act 2004, Schedule 1, paragraph 68.
