Section 567.

In section 56(1) (interpretation of Part 1)—

(a)

in the definition of “environmental licence”, both in relation to the Environment Agency and in relation to SEPA11—

(i)

in paragraph (aa), insert at the end “, other than regulations made for the purpose of implementing the EU ETS Directive”; and

(ii)

omit paragraph (k); and

(b)

after those definitions, insert—

““the EU ETS Directive” means Directive 2003/87/EC of the European Parliament and of the Council establishing a scheme for greenhouse gas emissions allowance trading within the Community and amending Council Directive 96/61/EC, as amended from time to time;”.
