12. In the Avian Influenza (Vaccination) (England) Regulations 2006 M1, in regulation 23 (enforcement), after paragraph (2) add—
“(3) Where the Secretary of State makes a direction under paragraph (2), the Secretary of State may delegate to the Director of Public Prosecutions functions in relation to the prosecution of an offence under section 73 of the Act M2 relating to these Regulations.”.
