28. In the Control of Salmonella in Broiler Flocks Order 2009 M1—
(a)in article 2 (interpretation), after the definition of “broiler flock” insert—
““Commission Regulation (EU) No 200/2012” means Commission Regulation (EU) No 200/2012 concerning a Union target for the reduction of Salmonella enteritidis and Salmonella typhimurium in flocks of broilers, as provided for in Regulation (EC) No 2160/2003 M2;”;
(b)in article 3 (competent authority), for paragraph (a) (but not the “and” at the end) substitute—
“(a)Commission Regulation (EU) No 200/2012;”;
(c)in article 5 (sampling), in paragraph (1)—
(i)for “Regulation (EC) No 646/2007” substitute “ Commission Regulation (EU) No 200/2012 ”,
(ii)for “3.1” substitute “ 2.2.4 ”, and
(iii)for “ “express post”” substitute “ “express mail” ”;
(d)in article 8 (duties of the person in charge of a laboratory), for “Regulation (EC) No 646/2007” substitute “ Commission Regulation (EU) No 200/2012 ”; and
(e)in article 14 (enforcement), after paragraph (2) add—
“(3) Where the Secretary of State makes a direction under paragraph (2), the Secretary of State may delegate to the Director of Public Prosecutions functions in relation to the prosecution of an offence under section 73 of the Animal Health Act 1981 relating to this Order.”.
