43. In the Environmental Protection (Controls on Ozone-Depleting Substances) Regulations 2011 M1—
(a)in regulation 2 (interpretation), after the definition of “the EU Regulation” insert—
““marine area” has the meaning given in paragraph 1(1) of Schedule 1;”;
(b)in regulation 7 (enforcement), after paragraph (2) insert—
“(2A) Where the Secretary of State makes a direction under paragraph (2), the Secretary of State may delegate to the Director of Public Prosecutions functions in relation to the prosecution of an offence under these Regulations.”; and
(c)in regulation 8(3) (powers of enforcing authorities and persons authorised by them), for “offshore area” substitute “ marine area ”.
