The Secretary of State is to be regarded as having taken all reasonable steps to notify an Affected Member as mentioned in paragraph 10(d) if he has taken all reasonable steps to notify that person in writing that—
a
if that person gives consent to the modification for the purposes of the Consent Requirements, those requirements apply in that person’s case in respect of the modification, but
b
otherwise, the Actuarial Equivalence Requirements apply in that person’s case in respect of the modification.
