The Secretary of State must from time to time—

a

carry out a review of these Regulations;

b

set out the conclusions of that review in a report; and

c

publish the report.

In carrying out the review the Secretary of State must, so far as is reasonable, have regard to how—

a

Council Directive 89/391/EEC on the introduction of measures to encourage improvements in the safety and health of workers at work M1 (which is implemented by means of regulations 4 and 6);

b

Council Directive 92/91/EEC concerning the minimum requirements for improving the safety and health protection of workers in the mineral-extracting industries through drilling M2 (which is implemented by means of regulations 4, 6 and 7);

c

Council Directive 92/104/EEC on the minimum requirements for improving the safety and health protection of workers in surface and underground mineral-extracting industries M3 (which is implemented by means of regulations 4, 6 and 7);

d

Directive 2000/54/EC of the European Parliament and of the Council on the protection of workers from risks related to exposure to biological agents at work M4 (which is implemented by means of regulations 7 and 9);

e

Directive 2004/37/EC of the European Parliament and of the Council on the protection of workers from the risks related to exposure to carcinogens or mutagens at work M5 (which is implemented by means of regulation 9);

f

Directive 2004/49/EC of the European Parliament and of the Council on safety on the Community's railways and amending Council Directive 95/18/EC on the licensing of railway undertakings and Directive 2001/14/EC on the allocation of railway infrastructure capacity and the levying of charges for the use of railway infrastructure and safety certification M6 (which is implemented by means of regulations 4, 6 and 7);

g

Regulation (EC) No 1338/2008 of the European Parliament and of the Council on Community statistics on public health and health and safety at work M7 (which is implemented by means of regulations 4, 6, 8 and 12); and

h

Council Directive 2010/32/EU implementing the Framework Agreement on prevention from sharp injuries in the hospital and healthcare sector concluded by HOSPEEM and EPSU M8 (which is implemented by means of regulation 7),

are implemented in other member States.

The report must in particular—

a

set out the objectives intended to be achieved by the regulatory system established by these Regulations;

b

assess the extent to which those objectives are achieved; and

c

assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved with a system that imposes less regulation.

The first report under this regulation must be published before the end of the period of five years beginning with the day on which these Regulations come into force.

Reports under this regulation are afterwards to be published at intervals not exceeding five years.
