Appeal to the First-tier TribunalU.K.

8.—(1) Section 37 of the Act M1 (appeals to magistrates' court or sheriff) applies for the purposes of these Regulations with the following modifications.

(2) For subsection (1), substitute—

(1) Any person who is aggrieved by a decision of an authorised officer of an enforcement authority to serve an improvement notice under section 10, as applied by regulation 7 of [F1the Fish Labelling Regulations 2013], may appeal to the First-tier Tribunal..

(3) Omit subsections (2) to (5).

(4) In subsection (6)—

(a)for “(3) or (4)”, substitute “ (1) ”;

(b)in paragraph (a), for “a magistrates' court or to the sheriff”, substitute “ the First-tier Tribunal ”.
