Coming into force

The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 and 12 of the Highways Act 19801 and now vested in him2 and3:—

This Order may be cited as The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Margidunum Roundabout (Detrunking) Order 2013 and shall come into force on 15th August 2013

In this Order—

a

“the new trunk roads” means the new highways which the Secretary of State proposes to construct referred to in article 2(2)(i) of The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Order 20094;

b

“the trunk road” means the Newark to Widmerpool Trunk Road (A46)

c

“principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

d

“the plan” means the plan numbered HA10/MP/112 shown on two sheets and marked “The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Margidunum Roundabout (Detrunking) Order 2013” signed by authority of the Secretary of State for Transport and deposited at Department of Communities and Local Government-DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Secretary of State notifies Nottinghamshire County Council that the new trunk roads are open for traffic when this Order comes into force.

The length of the trunk road ceasing to be a trunk road is situated between Newark and Widmerpool and is located between;

The point on the plan marked M, at Margidunum Roundabout and the point marked N at Margidunum Roundabout.

And is shown by broad black dashes on the plan.
