The Apprenticeships (Alternative English Completion Conditions) (Amendment) Regulations 2013

Coming into force

The Secretary of State for Business, Innovation and Skills makes the following Regulations in exercise of the powers conferred by sections 1(5) and 262(3) of the Apprenticeships, Skills, Children and Learning Act 20091.

In accordance with section 262(6) of that Act, a draft of this instrument was laid before Parliament and approved by a resolution of each House of Parliament.

Citation and commencement1

These Regulations may be cited as the Apprenticeships (Alternative English Completion Conditions) (Amendment) Regulations 2013 and come into force on the day after the day on which the Regulations are made.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Apprenticeships (Alternative English Completion Conditions) Regulations 2012 (“the Principal Regulations”) which make provision for circumstances where a person has not entered into an apprenticeship agreement but is under alternative working arrangements, by specifying the alternative English completion conditions which will entitle them to receive an apprenticeship certificate. Under regulation 3 of the Principal Regulations, the alternative English completion conditions are met where a person works in certain specified occupations as a self-employed person or otherwise than for reward. The relevant occupations are specified in Schedule 1 to the Principal Regulations.

These Regulations amend Schedule 1 to the Principal Regulations so as to specify a new English apprenticeship framework: Maritime Occupations (advanced), and four new occupations in relation to that framework: Merchant Navy (deck), Merchant Navy (engineering), Officer of the watch on merchant vessels of less than 500 gross tonnage (near coastal) including tugs and Officer of the watch on merchant vessels of less than 3,000 gross tonnage (near coastal) including tugs.

An impact assessment has not been prepared for these Regulations as they will have no impact on the costs of business, charities or the public sector. The Explanatory Memorandum is published alongside the Regulations on www.legislation.gov.uk.
