The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41of the Highways Act 19801 and now vested in him2 and3:

This Order may be cited as the M1 Motorway (Junction 19 Improvement) (A14 Trunk Road) Order 2013 and shall come into force on 29th August 2013.

In this Order, all measurements of distance are measured along the route of the relevant highway.

The new highway which the Secretary of State proposes to construct along the route described in the Schedule shall become a trunk road from the date when this order comes into force.

The centre line of the trunk road is indicated by a heavy black line on the plan numbered 1, marked “The M1 Motorway (Junction 19 Improvement) (A14 Trunk Road) Order 2013”, signed by authority of the Secretary of State for Transport and deposited at Document Deposit Service, Communities and Local Government, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

The Secretary of State directs as respects any part of a highway which crosses the route of the new trunk road that—

a

where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

b

where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the new trunk road is opened for traffic.

SCHEDULEROUTE OF THE NEW TRUNK ROAD

Article 2

The route of the new trunk road is about 0.80 kilometres in length, from the point on the plan marked A on the existing A14 Trunk Road, about 878 metres west of the centreline of the existing River Avon bridge under the A14 Trunk Road at Catthorpe in the County of Leicestershire, south-easterly to the point on the plan marked B on the existing A14 Trunk Road, about 81 metres west of the centreline of the existing River Avon Bridge.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order authorises the construction of a new length of trunk road to provide a dual carriageway route to connect with a new length of the M6 Motorway and the connecting slip roads to the existing northbound carriageway and from the exisiting southbound carriageway of the M1 Motorway.

The route of the main new trunk road is about 0.80 kilometres in length, from the point on the plan marked A on the existing A14 Trunk Road, about 878 metres west of the centreline of the existing River Avon bridge under the A14 Trunk Road at Catthorpe in the County of Leicestershire, south-easterly to the point on the plan marked B on the existing A14 Trunk Road, about 81 metres west of the centreline of the existing River Avon bridge.
