109.  In the School Governance (Federations) (England) Regulations 2007 M1 (so far as those Regulations continue to apply by virtue of regulation 4(1) of the School Governance (Federations) (England) Regulations 2012 M2), in Schedule 4 (appointment of community governors in federations which include community special schools), in paragraph 2—

(a)in sub-paragraph (1), for paragraph (a) substitute—

(a)one or more clinical commissioning groups,

(aa)the National Health Service Commissioning Board,, and

(b)in sub-paragraph (3)—

(i)before the definition of “National Health Service Trust” insert—

clinical commissioning group” means a body established under section 14D of the National Health Service Act 2006;, and

(ii)omit the definition of “primary care trust” and the “and” immediately preceding it.
