This rule applies if the applicant wishes to seek a direction from the court that the procedure in Chapter 4 of this Part should apply to an application for an order in proceedings referred to in rule 9.18(A1).

The application for the order must state—

a

that the applicant seeks a direction that the procedure in Chapter 4 of this Part should apply; and

b

the applicant’s reasons for seeking such a direction.

The court will—

a

determine without notice to the parties and before the first hearing whether the procedure in Chapter 4 or Chapter 5 of this Part should apply to the application; and

b

notify the parties of its determination and any directions made in consequence of that determination.
