Transitional provisions in relation to the abolition of Primary Care Trusts54.

(1)

This regulation applies in relation to dental charges following the coming into force of section 34 of the Health and Social Care Act 2012 (abolition of Primary Care Trusts).

(2)

For the purposes of this regulation “the 2005 Regulations” means the National Health Service (Dental Charges) Regulations 2005”.

(3)

Any act or omission by, or in relation to, the Primary Care Trust before 1st April 2013 in relation to the 2005 Regulations, is deemed to have been an act or omission of, or in relation to, the Board.

(4)

Anything which, before 1st April 2013, is in the process of being done by, or in relation to, the Primary Care Trust in respect of, or in connection with, the 2005 Regulations, is deemed to have effect as if done by, or in relation to, and may be continued by, or in relation to, the Board.

(5)

A form provided by a Primary Care Trust in connection with the 2005 Regulations in respect of the making and recovery of dental charges continues to be a valid form in relation to the Board until it is cancelled or withdrawn by the Board.
