PART 2 U.K.CONSEQUENTIAL AMENDMENTS

Amendment of the Child Support (Variations) Regulations 2000 U.K.

24.  In regulation 11 (special expenses – illness or disability of relevant other child) of the Child Support (Variations) Regulations 2000(1)—

(a) in paragraph (2)(a)(i) after “disability living allowance” insert “, personal independence payment”;

(b) omit “or” at the end of paragraph (2)(a)(ii);

(c) after paragraph (2)(a)(iii) insert—

“or

(iv) he would receive personal independence payment but for regulations under section 86(1) (hospital in-patients) of the Welfare Reform Act 2012 and he remains part of the applicant’s family;”;

(d) after the definition of “disability living allowance” in paragraph (2)(a) insert—

“(iia) “personal independence payment” means an allowance payable under section 78 of the Welfare Reform Act 2012 (daily living component);”; and

(e) in paragraph (3)(b)(2) after “disability living allowance” insert “or personal independence payment”.
