EXPLANATORY NOTE

Section 109 of the Localism Act 2011(1) abolished the regional planning tier by repealing Part 5 of the Local Democracy, Economic Development and Construction Act 2009(2) (which only applied in relation to England). This includes the removal of the responsible regional authorities. Section 109 of the Localism Act 2011 also made provision to revoke, by order, the whole or any part of a regional strategy under Part 5 of the 2009 Act and any remaining structure plan policies that were saved as part of the transitional provisions under Schedule 8 to the Planning and Compulsory Purchase Act 2004(3).

Article 2 of this Order partially revokes the regional strategy for the South East, which includes The South East Plan Regional Spatial Strategy for the South East of England. Policy NRM6 of The South East Plan, which relates to new residential development near the Thames Basin Heaths Special Protection Area, an area designated under European Directives 79/409/EEC (now codified in 2009/147/EC) and 92/43/EEC, is retained. The effect of Article 3 of this Order is to revoke all remaining structure plan policies in the region except for policy H2 of the Oxfordshire Structure Plan 2016, which relates to the former air base at Upper Heyford in Oxfordshire.
