2.—(1) Regulation 7 (registers) of the Care Standards Act 2000 (Registration) (England) Regulations 2010(1) is amended as follows.
(2) For paragraph (5) substitute—
“(5) Subject to paragraph (6), subsections (1) and (2) of section 36 of the Act do not apply to those parts of the register listed in paragraphs 1, 2, 3 or 10 of Schedule 5 and any inspection report in that register shall not contain the name and address of the children’s home or any other information by which the children’s home could be identified.”.
(3) After paragraph (5) insert—
“(6) Paragraph (5) does not apply in the case of a request to inspect the register, or for any of the information set out in that paragraph, made by:
(a)the Secretary of State for Education;
(b)a local authority;
(c)the chief officer of police for any police area in England for the purposes of safeguarding the welfare of children accommodated in children’s homes within that area; and
(d)the office of the Children’s Commissioner.”.
