Individuals not liable to make a paymentI19

This regulation applies where—

a

an individual is under the age of 18 on the date on which the application for a determination under section 16 of the Act is made; or

b

the Director is satisfied that an individual is, directly or indirectly, properly in receipt of a qualifying benefit.

The Director must as soon as possible notify an individual to whom this regulation applies that the individual is not liable to make a payment.

In this regulation, “qualifying benefit” means—

a

income support paid under section 124 of the Social Security Contributions and Benefits Act 19926 or section 123 of the Social Security Contributions and Benefits (Northern Ireland) Act 19927;

b

income-based jobseeker’s allowance paid under the Jobseekers Act 19958 or Part 2 of the Jobseekers (Northern Ireland) Order 19959;

c

guarantee credit paid under section 1(3)(a) of the State Pension Credit Act 200210 or section 1(3)(a) of the State Pension Credit Act (Northern Ireland) 200211;

d

income-related employment and support allowance paid under Part 1 of the Welfare Reform Act 200712 or section 1(2)(b) of the Welfare Reform Act (Northern Ireland) 200713; or

e

universal credit paid under Part 1 of the Welfare Reform Act 201214F1or Part 2 of the 2015 (Northern Ireland) Order.
