The Crossrail (Insertion of Review Clauses) Order 2014

The Secretary of State makes the following Order in exercise of the powers conferred by section 39(1) of, and paragraph 1(1) of Schedule 7 to, the Crossrail Act 2008(1).

In accordance with section 39(4) of the Crossrail Act 2008 he has consulted the Mayor of London.

Citation and commencement

1.  This Order may be cited as the Crossrail (Insertion of Review Clauses) Order 2014, and comes into force on 30th June 2014.

Amendment of the Crossrail (Nomination) Order 2008

2.  After article 4 in the Crossrail (Nomination) Order 2008(2) insert—

Review

5.(1) The Secretary of State must from time to time—

(a)carry out a review of this Order;

(b)set out the conclusions of the review in a report; and

(c)publish the report.

(2) The report must in particular—

(a)set out the objectives intended to be achieved by this Order;

(b)assess the extent to which those objectives are achieved; and

(c)assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved in another way.

(3) The first report under this article must be published before 31st December 2021.

(4) Reports under this article are afterwards to be published at intervals not exceeding eight years.

Amendment of the Crossrail (Qualifying Authorities) Order 2008

3.  After article 2 in the Crossrail (Qualifying Authorities) Order 2008(3) insert—

Review

3.(1) The Secretary of State must from time to time—

(a)carry out a review of this Order;

(b)set out the conclusions of the review in a report; and

(c)publish the report.

(2) The report must in particular—

(a)set out the objectives intended to be achieved by this Order;

(b)assess the extent to which those objectives are achieved; and

(c)assess whether those objectives remain appropriate and, if so, the extent to which they could be achieved in another way.

(3) The first report under this article must be published before 31st December 2021.

(4) Reports under this article are afterwards to be published at intervals not exceeding eight years.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Crossrail (Nomination) Order 2008 (article 2) and the Crossrail (Qualifying Authorities) Order 2008 (article 3).

The amendments insert provisions in each of those Orders requiring the Secretary of State to review their operation and effect, and to publish a report before 31st December 2021 and within every eight years after that.

Following a review it will fall to the Secretary of State to consider whether those Orders should remain as they are, or be revoked or be amended. A further instrument would be needed to revoke the Orders or to amend them.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
