PART 7Crew accommodation

Provision for certain older ships30.

A ship the keel of which was laid or which was at a similar stage of construction before 1st July 1979—

(a)

as respects crew accommodation which has not been substantially reconstructed or altered on or after that date, must comply with the requirements set out in Schedule 6 to the Merchant Shipping (Crew Accommodation) Regulations 1978 as if those Regulations had not been revoked;

(b)

as respects crew accommodation which has been substantially reconstructed or altered on or after that date but before 11th July 1997, must comply with the requirements set out in Part 1 of the Merchant Shipping (Crew Accommodation) Regulations 1978, as if they had not been revoked;

(c)

as respects crew accommodation which has been substantially reconstructed or altered on or after 11th July 1997 but before 7th August 2014, must comply with the requirements set out in the Merchant Shipping (Crew Accommodation) Regulations 1997.

(1)

A ship the keel of which was laid or which was at a similar stage of construction F2on or after 1st July 1979 but before 11th July 1997—

(a)

as respects crew accommodation which has not been substantially reconstructed or altered on or after 11th July 1997, must comply with the requirements set out in F3Part 1 of the Merchant Shipping (Crew Accommodation) Regulations 1978 M1, as if they had not been revoked;

(b)

as respects crew accommodation which has been substantially reconstructed or altered on or after 11th July 1997 but before F47th August 2014, must comply with the requirements set out in the Merchant Shipping (Crew Accommodation) Regulations 1997 M2.

(2)

A ship the keel of which was laid or which was at a similar stage of construction on or after 11th July 1997 but before F57th August 2014 must, as respects crew accommodation which has not been substantially reconstructed or altered on or after F57th August 2014, comply with the requirements set out in the Merchant Shipping (Crew Accommodation) Regulations 1997.

(3)

In this regulation “similar stage of construction” means the stage at which—

(a)

construction identifiable with a specific ship begins; and

(b)

assembly of that ship has commenced comprising at least 50 tonnes or one per cent of the estimated mass of all structural material, whichever is less.

(4)

A breach of F6paragraph (A1), (1) or (2) is an offence by the shipowner.
