Meaning of “seafarer employment agreement”3

In these Regulations, “seafarer employment agreement” means, in relation to a seafarer—
a
the written agreement required by regulation 9 of the Merchant Shipping (Maritime Labour Convention) (Minimum Requirements for Seafarers etc.) Regulation 2014 M1, where the seafarer works on a United Kingdom ship; or
b
the agreement governing the seafarer's work on the ship, where the seafarer works on a ship which is not a United Kingdom ship.

For the purposes of regulation 5, “seafarer employment agreement” includes a draft of the agreement referred to in paragraph (1) which has been prepared for signature but has not yet been entered into.
