Citation, commencement, and interpretation

1.—(1) These Regulations may be cited as the Independent Educational Provision in England (Prohibition on Participation in Management) Regulations 2014 and come into force on 1st September 2014.

(2) In these Regulations—

“the 2002 Act” means the Education Act 2002(1);

“the 2008 Act” means the Education and Skills Act 2008;

“caution” has the meaning given by section 8A(2) of the Rehabilitation of Offenders Act 1974(2);

“independent school” includes an alternative provision Academy that is not an independent school; and

“section 128 direction” means a direction given under section 128 of the 2008 Act.

2002 c.32. Chapter 1 of Part 10 applies to alternative provision Academies that are not independent schools as it applies to independent schools.
