Regulation 74 (exempt groundwater activities)

8.  For regulation 74(6) substitute—

“(6) On and after 1st January 2012, a person must not carry on a small sewage effluent groundwater activity unless it is—

(a) authorised by an environmental permit;

(b) registered as an exempt facility; or

(c) in relation to England only, on and after 1^st January 2015, an exempt activity that fulfils the requirements of paragraph 5A of Schedule 2.”
