Accommodation for persons who require nursing or personal care2

The provision of residential accommodation together with nursing or personal care.

Sub-paragraph (1) does not apply to the provision of accommodation—
a
to an individual by a shared lives carer under the terms of a shared lives agreement,
b
in a school,
c
in an institution within the further education sector or in a 16 to 19 Academy, or
d
in an institution within the further education sector where the number of persons to whom nursing or personal care and accommodation are provided is not more than one-tenth of the number of students to whom both education and accommodation are provided
