Citation, commencement, interpretation and extent1

This Order may be cited as the Public Bodies (Abolition of the National Consumer Council and Transfer of the Office of Fair Trading’s Functions in relation to Estate Agents etc) Order 2014.

This article comes into force on the day after the day on which this Order is made.

Subject to paragraph (4), articles 2, 3 and 4 of this Order come into force on 1st April 2014.

Article 3(1)(g) and paragraph 14 of Schedule 1 (repeal of reference to the National Consumer Council in Schedule 1 to the Public Bodies Act 2011) come into force on 2nd April 2014.

Subject to paragraphs (6) and (7), article 5 of this Order comes into force on 31st March 2014.

Article 5(3)(a)(ii) and paragraph 6 of Schedule 2 (repeal of reference to the Office of Fair Trading in Schedule 5 to the Public Bodies Act 2011) come into force on 1st April 2014.

Paragraph 16 of Schedule 2 (provision of information to the lead enforcement authority by the OFT) comes into force on the day after the day on which this Order is made.

An amendment or repeal made by this Order has the same extent as the enactment to which it relates.

In this Order—

  • “the 1979 Act” means the Estate Agents Act 19792;

  • “the 2002 Act” means the Enterprise Act 20023;

  • “the 2007 Act” means the Consumers, Estate Agents and Redress Act 20074;

  • “the 2007 Regulations” means the Money Laundering Regulations 20075;

  • Citizens Advice” means the National Association of Citizens Advice Bureaux6;

  • Citizens Advice Scotland” means the Scottish Association of Citizens Advice Bureaux7;

  • CMA” means the Competition and Markets Authority8;

  • the Commissioners” means the Commissioners for Her Majesty’s Revenue and Customs;

  • “the First-tier Tribunal” means the First-tier Tribunal constituted under section 3(1) of the Tribunal, Courts and Enforcement Act 20079

  • “the GCCNI” means the General Consumer Council for Northern Ireland10;

  • “the lead enforcement authority” means Powys County Council;

  • “the National Consumer Council” means the National Consumer Council established by section 1 of the 2007 Act;

  • “the OFT” means the Office of Fair Trading established by section 1 of the 2002 Act.

A reference in this Order to a consumer advocacy body is a reference to—

a

Citizens Advice,

b

Citizens Advice Scotland, or

c

the GCCNI.
