The Coal Industry Act 1994 (Commencement No. 8 and Transitional Provision) Order 2014

Coming into force

The Secretary of State, in exercise of the powers conferred by section 68(4) and (5)(b) of the Coal Industry Act 19941, makes the following Order:

This Order may be cited as the Coal Industry Act 1994 (Commencement No. 8 and Transitional Provision) Order 2014.

In this Order, “the Act” means the Coal Industry Act 1994.

Commencement of provisions2

Subject to article 3, the following provisions come into force on 28th April 2014—

a

section 67(8) of the Act, so far as it relates to provisions coming into force by virtue of paragraph (b);

b

Part 3 of Schedule 11 to the Act, so far as it relates to the repeals set out in the Schedule to this Order.

Transitional provision3

Any redundant mineworkers and concessionary coal payments scheme made under, or continued in force by virtue of, section 7 of the Coal Industry Act 19772 continues to have effect for the purpose of the recovery of any overpayments, notwithstanding the repeal of that provision.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force certain of the repeals specified in Part 3 of Schedule 11 to the Coal Industry Act 1994 not previously brought into force.

Certain of the repealed provisions related to payments schemes for the making of payments to redundant mineworkers and in respect of arrangements relating to concessionary coal. Article 3 makes transitional provision to enable the recovery of overpayments made under those payments schemes.

In addition, the provisions specified in section 68(2) of the Act came into force on 31st October 1994 by virtue of the Coal Industry (Restructuring Date) Order 1994 (S.I. 1994/2553) and the provisions specified in section 68(3) of the Act came into force on 27th March 2004 by virtue of The Coal Industry Act 1994 (Commencement No.7) and Dissolution of the British Coal Corporation Order 2004 (S.I. 2004/144).
