The Lord Chancellor makes the following Order in exercise of the power conferred by paragraph 2 of Schedule 1 to the Public Service Pensions Act 2013(1).

Citation and commencement

1.  This Order may be cited as the Public Service Pensions Act 2013 (Judicial Offices) (Amendment) Order 2015 and comes into force on 1st August 2015.

Amendments of the Public Service Pensions Act 2013 (Judicial Offices) Order 2015

2.—(1) The Schedule (specified judicial offices) to the Public Service Pensions Act 2013 (Judicial Offices) Order 2015(2) is amended as follows.

(2) After the entry for “Admiralty Registrar”, insert “Appointed Person for design right appeals”.

(3) Before the entry for “Assistant Judge Advocate General”, insert “Appointed Person for trademark appeals”.

(4) After the entry for “Chairman of the Reserve Forces Appeal Tribunal”, insert “Chairman of the Residential Property Tribunal Wales”.

(5) In the entry for “Chamber President or of a chamber of the Upper Tribunal”, omit “or”.

(6) After the entry for “Other member of the Upper Tribunal, where the office is held on a salaried basis”, insert “President or Chairman of the Special Educational Needs Tribunal for Wales”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Public Service Pensions Act 2013 (Judicial Offices) Order 2015 (S.I 2015/580) (“the 2015 Order”).

The 2015 Order specifies those judicial offices which comprise “the judiciary” for the purposes of the Public Service Pensions Act 2013 (c. 25). A person holding a judicial office specified in the Schedule to the 2015 Order is eligible to be included in a judicial pension scheme made under that Act.

This Order adds the offices of Appointed Person for design right appeals, Appointed Person for trademark appeals, Chairman of the Residential Property Tribunal Wales and President or Chairman of the Special Educational Needs Tribunal for Wales to the list of specified judicial offices in the 2015 Order.

A full impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sectors is foreseen.
