When this Part applies27.1

Rule 27.2 applies where, under section 54 of the Criminal Procedure and Investigations Act 1996513, the Crown Court or a magistrates’ court can certify for the High Court that interference or intimidation has been involved in proceedings leading to an acquittal.

Rules 27.3 to 27.7 apply where, under section 77 of the Criminal Justice Act 2003514, the Court of Appeal can―

a

quash an acquittal for a serious offence and order a defendant to be retried; or

b

order that an acquittal outside the United Kingdom is no bar to the defendant being tried in England and Wales,

if there is new and compelling evidence and it is in the interests of justice to make the order.
