Where ROCs cannot be revoked25

A ROC cannot be revoked where it has been produced to the Authority under article 7 or under article 5 of the 2009 Order.

Nor can a ROC be revoked by the Authority under article 24(2) or (4) more than six years after it has been issued.

Where the Authority would have revoked a ROC (“the original ROC”) under article 24(2) or (4) but for the fact that it has already been produced to it under article 7 or under article 5 of the 2009 Order, the Authority must, subject to paragraph (4), refuse to issue a further ROC (“the further ROC”) in respect of electricity generated by the generating station in relation to which the original ROC was issued.

The Authority must refuse to issue the further ROC under paragraph (3) only if the original ROC was—

a

issued no more than six years previously; and

b

not issued to an electricity supplier under article 18(3) to (5).
