The Secretary of State is a Minister designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the regulation of specifications, construction, placing on the market and use of equipment intended for weighing, measuring or testing or for ancillary purposes.

The Secretary of State makes these Regulations in exercise of the powers conferred by that section and the powers conferred by sections 10(1), 11(1) and (4), 15(1) and (2), 86(1) and 94(1)3 of the Weights and Measures Act 19854.
