46.—(1) A person who contravenes regulation 25(1) F1... is guilty of an offence and is liable on summary conviction to a fine not exceeding level 5 on the standard scale.

(2) The owner of a vessel who causes or permits it to begin a voyage when the person serving as its master is a person who contravenes regulation 25(1) F1... is guilty of an offence and liable on summary conviction to a fine not exceeding level 5 on the standard scale.

(3) It is a defence to a charge under this regulation that the person charged took all reasonable steps to avoid commission of the offence.
