Appointment of persons to carry out investigations40.
No person shall be appointed to carry out an investigation under regulation 42, 43 or 44 (investigation by the appropriate authority on its own behalf, supervised and managed investigations)—
(a)
unless that person has an appropriate level of knowledge, skills and experience to plan and manage the investigation;
(b)
if that person works, directly or indirectly, under the management of the person whose conduct is being investigated;
(c)
if that person’s involvement in the role could reasonably give rise to a concern as to whether that person could act impartially under these Regulations.
