3. In regulation 3—
(a)in the definition of “document” omit “or images”;
(b)after the definition of “proposed witness” insert—
““protected disclosure” has the meaning given to it by section 43A of the Employment Rights Act 1996(1);”;
(c)in the definition of “Standards of Professional Behaviour” after “means” insert “, subject to paragraph (9) of this regulation,”;
(d)after paragraph (8) insert—
“(9) For the purposes of these Regulations, the making of a protected disclosure by a police officer is not a breach of the Standards of Professional Behaviour.”.
1996 c.18. Part IVA of the Employment Rights Act 1996 was inserted by section 1 of the Public Interest Disclosure Act 1998 (c. 23) and is amended by sections 17, 18 and 20 of the Enterprise and Regulatory Reform Act 2013 (c. 24), section 37 of the Police Reform Act 2002 (c. 30), section 59 of, and paragraphs 84 and 85 of Schedule 4 to, the Serious Organised Crime and Police Act 2005 (c. 15) and section 15 of, and paragraphs 49 and 50 of Schedule 8 to, the Crime and Courts Act 2013 (c. 22).
